These Terms of Service ("Agreement") govern your use of www.maelawncare.com and all services provided by Maedgen's Lawn Care ("Company," "we," "our," or "us"). By accessing our website, requesting a quote, scheduling service, or engaging our services, you agree to be bound by these terms. If you do not agree, do not use our website or services.
1. Services Overview
What We Offer
Maedgen's Lawn Care provides professional lawn care and landscaping services including:
- Lawn mowing and maintenance
- Landscape design and installation
- Spring and fall cleanup
- Seasonal services
- Landscape restoration
- Commercial property management
- Specialized outdoor services
Service Area
We operate in and around:
- Rolla
- St. James
- St. Robert
- Waynesville
- Valley Park
Services outside these areas may be available by special arrangement.
Custom Quotes
All service pricing is provided through individual quotes based on property assessment, service type, frequency, and scope of work. No service is guaranteed until a formal agreement is signed.
2. Service Agreements & Contracts
Residential Services
Standard residential service typically involves:
- Initial site visit and quote (free)
- Formal service agreement specifying frequency and scope
- Regular scheduled service on agreed-upon dates
- Ongoing communication about property needs
Commercial Services
Commercial agreements include:
- Comprehensive site assessment
- Detailed service specifications
- Regular maintenance schedule with specific deliverables
- Quality standards and consistency requirements
Seasonal & One-Time Services
One-time or seasonal projects are governed by:
- Written project quote or estimate
- Scope of work and timeline
- Payment terms specific to the project
Agreement Binding
Once you sign a service agreement, both parties are bound to the terms. Any modifications must be made in writing and agreed to by both Maedgen's Lawn Care and the customer.
3. Scheduling & Service Dates
Confirmation
Service dates are confirmed when:
- You sign a service agreement, or
- We receive your written confirmation of a scheduled appointment, or
- We provide written confirmation via email or phone
Schedule Changes
Maedgen's Lawn Care maintains published schedules. We will not arbitrarily change scheduled service dates. If a change becomes necessary, we will provide at least 48 hours notice and work with you to reschedule.

Changes will be accommodated based on crew availability.
Weather Delays
We may reschedule service due to weather conditions that would compromise work quality or safety:
- Heavy rain or wet conditions
- Extreme heat or cold
- Severe storms
- Other weather-related hazards
We'll reschedule for the next available slot with no penalty.
4. Payment Terms & Billing
Payment Methods
We accept:
- Check
- Credit card
- Bank transfer
- Other methods as discussed at time of service
Billing Schedule
Payment terms vary by service type:
- Monthly maintenance: Invoice after service completion; due within 30 days
- Seasonal services: Typically due upon completion or as specified in estimate
- One-time projects: Payment schedule specified in project agreement
- Deposit requirements: May be required for large projects or new customers
Late Payments
Payments not received within 30 days of invoice are considered late. Late payments may result in:
- Service suspension until payment is received
- 1.5% monthly interest charge on outstanding balance
- Collection action if payment is not received within 60 days
Price Adjustments
We reserve the right to adjust pricing with 30 days written notice for:
- Significant changes in material or fuel costs
- Substantial changes in service scope or frequency
- Market conditions affecting industry-wide costs
Existing contracts will be honored at current rates for at least 12 months.
Refund Policy
- Satisfied with work: No refund; we stand behind our service
- Issues or concerns: Contact us immediately; we'll address problems and adjust future service or pricing as appropriate
- Service cancellation before completion: Refund for services not yet rendered; any partial work completed is billable
5. Cancellation & Termination
Cancellation by Customer
You may cancel ongoing service by:
- Providing written notice (email or mail)
- Giving at least 30 days notice
- Allowing completion of final scheduled service
Cancellation for Cause
We may suspend or terminate service if:
- Payment is more than 60 days overdue
- Your property access becomes unsafe or dangerous
- You violate terms of this agreement
- Service conditions change significantly (property sold, demolished, etc.)
We'll provide written notice and 30 days to remedy the issue before termination, except in cases of safety hazard or criminal activity.
Month-to-Month Service
Service without a formal long-term contract can be terminated by either party with 30 days written notice.
Refunds Upon Termination
Upon cancellation:
- You're responsible for payment of all services provided
- If you've prepaid and services are incomplete, we'll refund the prepaid amount for unrendered services (minus any work completed)
- We're not responsible for your property maintenance after service ends
6. Liability & Damage Claims
Our Responsibility
Maedgen's Lawn Care is responsible for:
- Performing services with professional skill and care
- Using industry-standard techniques and equipment
- Conducting work safely and in compliance with applicable laws
- Protecting your property from foreseeable damage during service
Property Damage During Service
If we damage your property through negligence or error:
- We will assess the damage within 24 hours
- We will provide a repair estimate in writing
- We will handle repair or reimburse reasonable repair costs
- Maximum liability is limited to the estimated repair cost, not to exceed the annual service contract value
Our Limitations
We are NOT responsible for:
- Pre-existing property damage or lawn conditions
- Damage from weather, acts of God, or natural disasters
- Hidden obstacles (underground utilities, rocks, etc.) unless discovered through our work
- Damage to underground sprinkler systems, utilities, or infrastructure (you must mark their locations)
- Consequential or indirect damages
Underground Utilities
You are responsible for:
- Identifying and marking underground utilities (electric, gas, water, septic)
- Informing us of utility locations in writing before service begins
- Responsibility for damage to utilities we were not informed about
Lawn Conditions
We do not guarantee:
- Specific lawn appearance or color
- Elimination of all weeds, pests, or disease
- That your lawn will match neighbors' lawns or your expectations
Lawn health depends on many factors including watering, fertilization, weather, and soil conditions.
7. Warranties & Disclaimers
Limited Service Warranty
We warrant that services will be performed in a professional, workmanlike manner consistent with industry standards. If service is not satisfactory, contact us within 7 days for review and adjustment.
No Warranty for Results
We do not warrant specific results such as:
- Lawn appearance, color, or density
- Complete weed or pest elimination
- Disease prevention or cure
- Specific growth rates or plant survival
- Landscaping durability beyond typical expectations
No Other Warranties
EXCEPT AS EXPRESSLY STATED, WE MAKE NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
Disclaimer
Use of our website and services is at your own risk. We disclaim responsibility for:
- Website availability or functionality
- Interruptions or errors in service
- Third-party services we link to or recommend
- Information accuracy on our website
- Losses resulting from service cancellations due to weather or other circumstances
8. Indemnification
You agree to indemnify and hold harmless Maedgen's Lawn Care, its owners, employees, and agents from any claims, damages, or expenses resulting from:

- Violation of applicable laws
- Your negligence or willful misconduct
- Third-party claims arising from your property or actions
This includes reasonable attorney fees and court costs.
9. Insurance & Worker's Compensation
Maedgen's Lawn Care maintains:
- General liability insurance for our operations
- Worker's compensation insurance for our employees
- Equipment and vehicle insurance
You are responsible for:
- Homeowner's or business property insurance
- Liability for third-party claims on your property
- Obtaining consent from property owners or managers before service
10. Intellectual Property

All content on www.maelawncare.com including:
- Text, images, logos, and designs
- Service descriptions and materials
- Customer testimonials and case studies
is the property of Maedgen's Lawn Care or our licensors. You may not copy, modify, or distribute this content without written permission.
Limited License
We grant you a limited license to view and print pages for personal, non-commercial use only.
11. Website Terms & Conditions
Website Use
You agree to use our website only for lawful purposes:

13. Severability

14. Entire Agreement
This Terms of Service, along with any formal service agreement you sign, constitutes the entire agreement between you and Maedgen's Lawn Care. Prior negotiations, representations, or agreements are superseded by this document.
15. Modification of Terms
We reserve the right to modify these Terms of Service at any time:
- Changes will be posted on this page
- The "Last Updated" date will be revised
- Your continued use of our services constitutes acceptance of changes
- For significant changes, we'll attempt to notify you via email
